The federal government has not yet decided on whether it will pursue a third trial against former Bordentown Township police chief Frank Nucera. A second jury could not decide whether Nucera, who is white, assaulted Timothy Stroye because he was Black, the threshold for a hate crime conviction.

Legal analysts tell WHYY's Kenneth Burns that the government will have to have a long, hard look at their case as they decide.
